NelsaHost is a Netherlands hosting provider that values freedom of speech and privacy. We operate under Dutch and European Union law, and we are a DMCA-ignored hosting provider.
Our Philosophy: We believe in minimal restrictions and maximum privacy. However, certain activities are prohibited to ensure legal compliance and network integrity.
2. Strictly Prohibited Content
The following content will result in immediate service termination without refund:
- Child Sexual Abuse Material (CSAM): Any content depicting or promoting the sexual exploitation of minors is absolutely forbidden
- Terrorism & Violent Extremism: Content that directly incites, coordinates, or facilitates terrorist activities or extreme violence
- Content Illegal Under Dutch/EU Law: Content that violates Dutch criminal law or EU regulations
3. Network Abuse Prohibited
Activities that harm network infrastructure or other users are not permitted:
- Spam: Mass unsolicited email or messages
- Phishing: Fraudulent attempts to obtain sensitive information
- Malware Distribution: Hosting or distributing malicious software
- DDoS Attacks: Launching or coordinating distributed denial of service attacks
- Port Scanning: Unauthorized network scanning or intrusion attempts
- Cryptocurrency Mining: Unauthorized use of shared resources for mining (dedicated servers excluded)
4. What We DO Allow
Unlike many traditional hosting providers, we explicitly allow:
- Copyrighted Content: We do not respond to DMCA notices as we operate under Dutch law
- Adult Content: Legal adult content is permitted (18+ only)
- Political Content: All forms of political speech and activism
- Whistleblowing Platforms: Platforms for anonymous reporting and disclosure
- Privacy Tools: VPN services, proxies, Tor nodes, and similar privacy-enhancing services
- File Sharing: Torrent trackers and file-sharing platforms
- Controversial Content: Content that may be controversial or censored in other jurisdictions
5. DMCA Policy
NelsaHost does not comply with DMCA takedown requests. We are located in the Netherlands and operate under Dutch and EU law. The DMCA is a United States law and does not apply to our operations.
We only respond to valid legal orders issued by Dutch courts or through proper EU legal channels.
6. Resource Usage
Fair use of allocated resources is expected:
- Use resources within your plan specifications
- Do not negatively impact other customers on shared infrastructure
- Excessive resource usage may require upgrade to higher-tier plan
7. Abuse Reporting
If you encounter prohibited content on our network:
- Contact us through the client area with specific details
- Include evidence of policy violation
- We investigate all legitimate abuse reports
8. Compliance Investigations
If we receive a valid legal complaint or court order from Dutch/EU authorities, we will:
- Investigate the specific content in question
- Notify you of the complaint (unless prohibited by court order)
- Take action only if required by Dutch or EU law
9. Server Security
You are responsible for securing your server:
- Keep software and applications updated
- Use strong passwords and SSH keys
- Configure firewalls appropriately
- Monitor for unauthorized access
Compromised servers used for abuse may be temporarily suspended for investigation.
10. Backup Responsibility
You are solely responsible for maintaining backups of your data. While we maintain infrastructure redundancy, we do not provide backup services unless explicitly purchased.
11. Violation Consequences
Violations of this policy may result in:
- Warning: For minor or first-time violations
- Temporary Suspension: For investigation of serious violations
- Immediate Termination: For prohibited content (no refund)
- Legal Action: For criminal activity under Dutch law
12. Appeals Process
If your service is suspended or terminated:
- You may submit an appeal through the client area
- Provide evidence that no violation occurred
- Appeals are reviewed within 48 hours
Note: Accounts terminated for prohibited content (CSAM, terrorism) cannot be appealed.
13. Policy Updates
This policy may be updated to reflect changes in Dutch/EU law or operational requirements. Continued use of services after updates constitutes acceptance.
